1. Acceptance of Terms
By accessing or using BackTrack ("the Service"), available at getbacktrack.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BackTrack ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Service
BackTrack is a web application that:
- Connects to your Gmail account via read-only OAuth authentication
- Scans your inbox for emails related to purchases, returns, and refunds
- Extracts and displays return and refund information on a personalized dashboard
BackTrack does not send, modify, or delete any emails in your Gmail account. Our access is strictly limited to reading emails for the purpose of identifying return and refund activity.
3. Eligibility
You must be at least 13 years old to use BackTrack. By using the Service, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into a binding agreement
- Your use of the Service does not violate any applicable law or regulation
If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. Account Registration
To use BackTrack, you must create an account and connect your Gmail account via Google's OAuth 2.0 authentication. You agree to:
- Provide accurate and complete information when registering
- Maintain the security of your account credentials
- Notify us immediately at support@getbacktrack.co if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. Gmail Access and Google's Terms
By connecting your Gmail account to BackTrack, you authorize us to access your Gmail data in accordance with the permissions you grant through Google OAuth. You acknowledge that:
- BackTrack's use of Gmail data is governed by both these Terms and Google's Terms of Service
- You may revoke BackTrack's access to your Gmail account at any time through your Google Account permissions page
- Revoking Gmail access will disable core functionality of the Service but will not automatically delete data already stored in your BackTrack account
- You are responsible for ensuring that your use of BackTrack complies with any applicable policies governing your Gmail account (e.g., if using a Google Workspace account provided by your employer)
6. Acceptable Use
You agree to use BackTrack only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable federal, state, or local law or regulation
- Attempt to gain unauthorized access to any part of the Service, other user accounts, or our systems
- Use automated tools, bots, or scrapers to access or interact with the Service without our express written consent
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit any unsolicited or unauthorized advertising, spam, or promotional material
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload or transmit viruses, malware, or any other malicious code
7. Intellectual Property
All content, features, and functionality of BackTrack — including but not limited to the software, design, text, graphics, logos, and user interface — are owned by BackTrack and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any portion of the Service without our prior written consent.
8. User Data and Privacy
Your use of BackTrack is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
You retain ownership of your personal data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.
9. Third-Party Services
BackTrack integrates with Google's Gmail API and may rely on other third-party services to operate. We are not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
Links to third-party websites or services are provided for convenience only and do not constitute an endorsement by BackTrack.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR DATA PROVIDED THROUGH THE SERVICE
BackTrack displays return and refund information parsed from your emails. We do not guarantee that all return or refund emails will be detected, that parsed information will be complete or accurate, or that displayed data reflects your current return or refund status with any retailer. You should always verify return and refund details directly with the relevant retailer.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BACKTRACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
- ANY OTHER MATTER RELATING TO THE SERVICE
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless BackTrack and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including any intellectual property or privacy rights
- Your violation of any applicable law or regulation
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms.
You may terminate your account at any time by contacting us at support@getbacktrack.co. Upon termination, your right to use the Service will immediately cease. We will delete your stored data in accordance with our Privacy Policy.
Sections 7, 10, 11, 12, 14, and 15 of these Terms shall survive termination.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the dispute is not resolved within 30 days, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and BackTrack each waive any right to a jury trial and agree that disputes will be resolved individually — not as a class action or representative proceeding.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BackTrack regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure. We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, internet outages, or third-party service disruptions.
